Communication
Concerning the request of Commissioner for information of public importance Rodoljub Sabic that the Government of Serbia enables execution of the decision of the commissioner by which the Ministry of Defence is obligated to submit to Beta Agency data about the price of overhaul and usage of MiG-29 aircraft at the Armed Forces of Serbia, we once again underline that the Ministry of Defence submitted the information about the price of the overhaul of MiG-29 aircraft to Beta Agency on November 27, 2012.
Publishing concrete data about the on-call work of aviators, hours of flight, training and the number of capacitated pilots would directly endanger elements of national security of the republic of Serbia, since MiG-29 planes are used in constantly engaged forces for control and protection of sovereignty of airspace of the Republic of Serbia by the provision ranked STATE SECRET.
We underline that making the requested data public is a criminal act of betrayal of military secrecy from Article 415 of Criminal Code of the Republic of Serbia. Namely, the data that are considered secret are those that have been proclaimed military secret by law, other provision or decision of a body of authority and whose publishing would cause or might cause severe consequences for the Armed Forces of Serbia, defence and security of the state. For the aforementioned criminal act, the law proscribes imprisonment from six months to five years, and up to eight years for the qualified, i.e. more severe form.
We would like to remind the public that Article 9 Paragraph 1 Items 3 and 5 of the Law on Free Access to Information of Public Importance states that an authority will not enable free access to information of public importance if it would endanger defence of the state, national or public security.
