Minister Dragan Sutanovac has started an initiative to stop any prosecution of conscripts who avoided military obligation and to suspend all prosecution proceedings based on this cause.

In a memo sent to the Ministry of Justice and the High Council of Judges, the Minister states that the basic cause for this initiative is placing all conscripts in an equal position, and that all preconditions for this were met once all regulations pertaining to this became effective.

Since the National Assembly has reached a decision on Suspending the obligatory conscript duty and that as of 1 January 2011 recruits will voluntarily sign up for the army, this significantly reduces the possibility of being charged with avoiding military obligation, as the memo reads.

In the period from 3 April 2010 (when the Law on Amnesty came into force) till today, the territorial organs of the Ministry of Defense pressed a total of 46 charges against conscripts who did not perform their military duty, and there are an 41 ongoing proceedings in the courts of law.
