PRESS RELEASE
With respect to information that leaked into the media that the Ministry of Defense and “Partizan” sports society hereby we state the following:
The contracted drafted on 28 March 1990 between the Federal Republic of Yugoslavia-Federal Secretariat for National Defense and JSp “Partizan” the right of availability and use of real estates in possession of JNA has been transferred without any compensation.
On 19 November 1997, representing FRY-Federal Ministry of Defense, Military Public Attorny filed a complaint against JSP “Partizan” in order to declare this agreement null and void together with a proposal for temporary restriction of possible alienation and burdening of the property.
The main cause of complaint was that at the time of transfer of property from the plaintiff to the party sued, there was no legal interest of national defense, which meant breaking Article 34 of the Law based on which this property was placed at the deposal of JSP “Partisan”.
The MoD Directorate for Property Affairs, authorized by the Public Attorney, renewed the complaint on 20 March 2007.
During the proceedings, the Second Municipality Court reached a verdict which reads that Partizan is hereby prohibited from any alienation and burdening of immovable property until the lawsuit is finalized. Following this decision of the court, the Belgrade District Court rejected the defender’s complaint thus confirming the decision of the Second Municipality Court.
Therefore, with respect to insinuations that it was the Minister of Defense Dragan Sutanovac who had signed the aforementioned complaint, and for the purpose of correct and timely informing of the public, we remind you that the minister took office 15 May 2007.
